BrassHaven Terms of Service
IMPORTANT - DISPUTE RESOLUTION / ARBITRATION / CLASS ACTION WAIVER: Section 10 contains an agreement to arbitrate most disputes and a waiver of class actions and jury trial. Please read Section 10 carefully.

These Terms of Service for Customers (Terms) are between you (Customer, you, your) and Onthegocode LLC d/b/a BrassHaven (BrassHaven, we, us, our). BrassHaven provides an online booking/reservation interface and related payment facilitation tools (the Service). By completing a reservation or purchase through the Service (a Booking), you confirm that you have read, understand, and agree to these Terms.
1. Relationship Between You, the Provider, and BrassHaven
1.1 Activity Contract (You and Provider): When you make a Booking offered by a third party (the Provider), you enter into a direct contract with that Provider (the Activity Contract). BrassHaven is not a party to the Activity Contract.
1.2 Provider Responsibilities: The Provider is solely responsible for delivering the booked activity/service, setting and honoring refund/reschedule policies, providing safety rules/waivers, and complying with applicable laws.
1.3 BrassHaven's Role: BrassHaven provides the Service to view availability/content, submit booking details, and pay through integrated tools. BrassHaven does not own or operate Provider activities or supervise Provider staff.
1.4 No Partnership or Agency: Nothing in these Terms creates a partnership, employment, joint venture, or agency between BrassHaven and any Provider.
1.5 Payments: BrassHaven may facilitate payments and may act as a limited payment collection agent for the Provider.
1.6 Authorization to Charge: You authorize charges for the Activity Price, Service/Booking Fee (if any), taxes, and allowed add-ons such as gratuity.
1.7 Provider Content: Providers control their descriptions, schedules, and rules. BrassHaven does not guarantee accuracy or completeness.
2. Conditions for Using the Service
2.1 Eligibility: You are at least 18 (or legal majority where you live), can form a binding contract, and are using the Service for legitimate personal bookings.
2.2 Booking for Others: If you book for someone else, you ensure they understand and agree to applicable rules and waivers.
2.3 Accurate Information: Provide accurate contact and payment information and confirm details before payment.
2.4 High-Risk Activities: Some activities involve inherent risks; follow Provider instructions and waivers as required.
3. Fees, Taxes, and International Charges
3.1 Service/Booking Fee: May be charged and shown before you pay.
3.2 Taxes: May apply to the Activity Price and/or Service Fee and will be shown where required.
3.3 International / Bank Fees: Your bank may charge additional fees that BrassHaven does not control.
3.4 Foreign Exchange / Cross-Border Service Fee: For certain international, cross-border, or foreign-exchange transactions, we may charge an additional service fee. Any such fee will be disclosed before payment.
3.5 Refunds and Fees: Provider controls refunds of the Activity Price; Service Fee is generally non-refundable unless BrassHaven chooses otherwise or law requires.
4. Cancellations, Refunds, Changes, Errors, and Availability
4.1 Provider Policy Controls: Eligibility to cancel, reschedule, or receive a refund follows Provider policy shown at checkout.
4.2 Corrections: Errors may be corrected, including cancellation or adjustment to fix issues.
4.3 Service Availability: Service may be unavailable due to maintenance or outages.
4.4 Chargebacks: Relevant Booking information may be shared to respond to disputes.
5. Access, Acceptable Use, and Interference
Do not use bots or scrapers without permission, probe or interfere with security or performance, or bypass access controls. Access may be suspended for violations or suspected fraud or abuse.
6. Intellectual Property
The Service is owned by or licensed to BrassHaven. You receive a limited, revocable license for personal booking use.
7. Privacy and Communications
7.1 Privacy Policy: Use is governed by our Privacy Policy.
7.2 Sharing: Your information may be shared with Providers and vendors to perform the Service.
7.3 Nevada Privacy Requests: Contact contact@brasshaven.com.
7.4 Communications: You consent to transactional email and SMS; marketing, if any, will include opt-out.
8. Suspension and Termination
Access may be suspended or terminated for violations, fraud, abuse, or as required by law.
9. Disclaimers and Limitation of Liability
9.1 Disclaimer: Service is provided "AS IS" and "AS AVAILABLE" without warranties.
9.2 Provider Disputes/Injuries: Disputes about the activity are between you and the Provider.
9.3 Limitation: BrassHaven is not liable for indirect or special damages; total liability is capped at the greater of the Service Fee you paid for the Booking or $100, subject to applicable law.
10. Arbitration Agreement (U.S.) and Class Action Waiver
10.1 Agreement to Arbitrate: Most disputes will be resolved by binding arbitration.
10.2 Class/Jury Waiver: Claims must be individual; jury trial is waived.
10.3 Exceptions: Small claims and intellectual property injunctions may go to court.
10.4 Rules: Arbitration is administered by AAA under Consumer Arbitration Rules unless agreed otherwise.
10.5 Location: Proceedings may use video, phone, or written submissions; in-person proceedings are in Clark County, Nevada unless AAA rules require otherwise.
10.6 Pre-Arbitration Notice: Email contact@brasshaven.com or mail Onthegocode LLC d/b/a BrassHaven, Attn: Legal Notices, c/o Registered Agent, 732 S 6TH ST STE R, LAS VEGAS, NV 89101, USA.
10.7 Opt Out: You have 30 days from first acceptance to opt out by emailing contact@brasshaven.com with your details and opt-out statement.
11. Miscellaneous
11.1 Governing Law: Nevada law, with the Federal Arbitration Act for arbitration, governs.
11.2 Severability: Unenforceable provisions will be modified to the minimum extent; the rest remains.
11.3 Entire Agreement: These Terms, checkout policies, and Privacy Policy form the agreement.
11.4 Changes: Updated Terms apply to future Bookings; see "Last updated."
